Major Issues With HOA...Help?!?!?

About two years ago, we purchased a foreclosure in Gilbert, AZ. We went through a title company and never signed any contract with the HOA nor received any paperwork at all from them. Three months later we found out from a neighbor that there was an HOA. Immediately my mom called them to find out what we owed, etc. The person she talked to assured my mom that there was no account because we had not signed any papers and announced that we didn't have to sign, we simply would not be held to anything in our HOA (no landscaping, newsletter, etc.). We agreed to this and have had no problems with them.

Today we received a phone call saying that we are going to be sued by our HOA for assessment fees close to $2000. Is this legal? Can they really do this to us now?

If there is a deed restriction recorded against the property, you don't need to sign anything from the HOA to be part of it and you would owe the money. Talk to a lawyer now. They can foreclose your home.
