Landscaping Maintenance Agreements

landscaping maintenance agreements
Is it legal for my landlord to come over to plant fruit trees in the backyard?

Our landlord wants to plant fruit trees in the backyard. He told us he's going to come over tomorrow to see where he can plant them.

Is this legal? I know when you sign a lease, you agree to provide maintenance to any landscaping currently there, but can the owner just come by throughout our lease and plant more items? Not to mention, invading our privacy as tenants?

Lastly, they sent me an e-mail saying that in addition, they "like to visit the home every 3 or 4 months" or so. That is not in our lease agreement. Is this legal?

If it is legal, it would be much appreciated if you could post the statutory code as well. Thanks!

Thanks in advance!
Wanted to add - we are in CA.

The landlord can enter his yard without any notice; notice is only required when entering the actual rental unit/house. CA requires 24 hour notice. No one is invading your privacy; if you want total privacy, then buy a house.

As long as your landlord provides you with proper notice before he comes, he can enter the house as often as he would like. It is customary to perform routine inspections like this to make sure you are not violating the lease and repairs are not needed. If he suspects that you are breaking the lease, or in the case of an emergency or illegal activity, notice is not required. For example, if your lease state you cannot have pets, but a neighbor called him complaining about a barking dog, he can enter unannounced to check. Typically has to be within normal business hours, though.

You can easily Google "CA civil code" to research California's landlord/tenant law. I think civil code 1946-1955 spans landlord/tenant law.
